Egan, Flanagan & Cohen is pleased to announce that its attorneys, Jack Egan, Lauren F. Olanoff, and Robert Quinn, have successfully represented the Town of Longmeadow in reaching a favorable settlement in two complex legal cases involving land acquisition and environmental contamination at 170 Dwight Road. This settlement, achieved just prior to the start of jury selection, brings closure to the disputes that have spanned several years.
The cases, initiated in 2019 and 2021 respectively, addressed a land taking dispute and environmental contamination issues on the site, which currently houses Longmeadow’s Department of Public Works garage and offices. Egan, Flanagan & Cohen’s legal team successfully negotiated a resolution in which the previous landowner will make a $400,000 payment to the Town of Longmeadow and withdraw its lawsuit seeking further compensation.
In return, the Town of Longmeadow will dismiss its lawsuit against the previous landowner regarding environmental claims at the site. The settlement, approved by Hampden County Superior Court today, resolves both cases as the trial was set to commence.
“The resolution of this matter reflects a mutual desire to avoid further litigation and focus on the community’s interests,” said Lyn N. Simmons, Town Manager. “We are pleased to have reached an outcome that is beneficial to the Town and allows us to move forward.”
